Welcome to Bonus Club. By using our application, you agree to the following Terms and Conditions of Use. Please read them carefully.
1. Definitions
- App: The Bonus Club application, available for mobile devices, which allows users to accumulate points, stamps, cashback, and gift cards, as well as participate in promotional campaigns.
- User: Any person who registers and uses the App.
- Stores: Includes individual stores, branches, and franchises that participate in the App’s system.
- Campaigns: Promotions, offers, and marketing campaigns created by participating stores.
- Personal Data: Any information related to an identified or identifiable natural person, as defined by the GDPR and LGPD.
2. User Registration and Account
To use the App, you must create an account by providing personal information, including but not limited to, name, age, gender, email address, and other necessary data. You agree to provide true, accurate, current, and complete information.
3. Use of Personal Data
3.1 Data Collection and Storage
The personal data provided by you when registering in the App will be collected and stored in accordance with the General Data Protection Regulation (GDPR - Regulation (EU) 2016/679) and the Brazilian General Data Protection Law (LGPD - Law No. 13,709/2018). This data includes, but is not limited to, name, gender, age, purchase history, and preferences.
3.2 Purpose of Data Use
The collected data will be used to:
- Generate personalized campaigns based on your profile and consumption behavior.
- Facilitate your participation in loyalty programs, cashback, stamps, and gift cards offered by the stores.
- Provide customer support and user service.
3.3 Data Sharing with Stores
By participating in campaigns or programs of a specific store, you agree that your relevant personal data may be shared with that store for the execution of the campaigns, including but not limited to segmentation by gender, age, purchase frequency, and other metrics.
3.4 International Data Transfer
Users’ personal data may be transferred and stored outside their country of residence, including transfers to Portugal, where our headquarters is located. These transfers will be carried out in compliance with the GDPR and LGPD, ensuring an adequate level of personal data protection.
3.5 Consent for International Transfer
By using the App and providing your personal data, you expressly agree to the transfer of your data to Portugal and other countries that offer an adequate level of protection as established by the applicable law. If you do not agree with the transfer, you may choose not to use the App or revoke your consent at any time as provided in Section 4.3.
3.6 Data Analysis and Artificial Intelligence
The data may be analyzed and processed by artificial intelligence algorithms to improve campaign personalization, optimize user experience, and provide insights to participating stores.
4. User Rights
4.1 Access and Correction
You have the right to access and correct your personal data at any time through the App.
4.2 Data Portability
You have the right to request the portability of your data to another service provider, under the conditions stipulated by the GDPR and LGPD.
4.3 Revocation of Consent
You may revoke your consent for the use of your personal data at any time. However, revocation may result in the inability to participate in some of the App’s functionalities.
4.4 Data Deletion
You have the right to request the deletion of your personal data, except in cases where data retention is necessary to comply with legal or contractual obligations or to defend rights in legal proceedings.
4.5 Objection and Restriction
You have the right to object to the processing of your personal data for direct marketing purposes or to request restriction of processing under certain circumstances as provided by the GDPR and LGPD.
5. Data Security
We implement technical and administrative security measures to protect your personal data against unauthorized access, loss, alteration, or destruction, in compliance with the obligations established by the GDPR and LGPD.
6. International Data Transfer
If your personal data is transferred outside the European Economic Area (EEA) or Brazil, we ensure that such transfer will be made in compliance with the provisions of the GDPR and LGPD, ensuring an adequate level of data protection.
7. Responsibilities
7.1 User Responsibilities
The user is responsible for maintaining the confidentiality of their account information, including login and password. The use of the App is solely at your own risk.
7.2 App Responsibilities
Bonus Club is not responsible for any damages or losses resulting from improper use or inability to use the App, except as provided by applicable law.
8. Changes to Terms and Conditions
Bonus Club may modify these Terms and Conditions at any time, with prior notice of [x] days. Continuing to use the App after the modification implies your acceptance.

10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the European Union, including the GDPR, for users in Europe, and by Brazilian laws, including the LGPD, for users in Brazil. Any disputes will be resolved in the competent courts of the jurisdiction where you reside.
